Approving The Procedure Of Recognition And Determining The Equivalence (Nostrification) Of International Documents Confirming Education And Academic Degrees, And Forms Of Corresponding Certificates



Order of the Ministry for General and Professional Education of the Russian Federation No. 15 of January 9, 1997


          According to the Law of the Russian Federation "About education" in the Federal law revision No. 12-FZ of January 13, 1996, and the Federal law "About Higher and Postgraduate Professional Education" No.125-FZ of August 22, 1996, in order to assure effective participation of the Russian Federation in the world market of educational services and skilled labor

ORDER:

          1. To approve the procedure of recognition and determining the equivalence (nostrification) of international documents confirming education and academic degrees, and forms of corresponding certificates (Appendices 1 to 9).
          2. To establish that certificates of recognition and equivalence of documents shall be made centrally. Certificate forms shall be documents subject to strict registration and reporting procedures, shall bear registration series and number, and shall be manufactured typographically. Forms shall be stored in the Ministry for General and Professional Education of the Russian Federation and shall be registered in a special register.
          3. Mr. N.D. Podufalov, Deputy Minister, shall assure the making of forms for the above-stated certificates.
          4. The control over performance of this order shall be delegated to the Deputy Minister of general and professional education of the Russian Federation (В.А. Bolotov).

To the Order of the Ministry of General And Professional Education Of the Russian Federation

PROCEDURES Accepting and establishing equivalence (nostrification) of international documents confirming education and academic degrees

General provisions

           1. According to the Law of the Russian Federation "About education" in the Federal law revision No. 12-FZ of January 13, 1996, and the Federal law "About Higher and Postgraduate Professional Education" No.125-FZ of August 22, 1996, the issue of recognition and determining the equivalence (nostrification) of international documents certifying general education, elementary, undergraduate and higher professional education, and certifying academic degrees in the territory of the Russian Federation shall fall within competence of the Ministry for General and Professional Education of the Russian Federation (hereinafter - the Ministry).
          2. According to item 1 of clause 23 of the Federal law No.125-FZ of August 22, 1996, the recognition of international documents confirming Higher and Postgraduate Professional Education and academic degrees shall be understood as the consent of corresponding bodies to recognize validity of these documents in the territory of the Russian Federation.
          Item 2 of the same clause states that determining the equivalence of international documents certifying Higher and Postgraduate Professional Education and academic degrees means granting by relevant government authorities to bearers of the mentioned documents the same academic and (or) professional rights as the bearers of documents of the Russian Federation confirming higher and postgraduate education and academic degrees.
          3. According to item 3 of clause 23 of the Federal law No.125-FZ of August 22, 1996, the fact of recognition and determining the equivalence of international documents certifying Higher and Postgraduate Professional Education shall not relieve bearers of the mentioned documents from observing general requirements of admittance in educational institutions or employment (including the condition of knowledge of the official language) which are established by relevant provisions.
          4. Recognition and determining the equivalence of international documents confirming education and academic degrees, and issuing certificates of acceptance or equivalence of documents shall be performed by the Department of Licensing, Accreditation and Nostrification of the Ministry for General and Professional Education of the Russian Federation (hereinafter - the division), if this equivalence is not established by relevant intergovernmental or interdepartmental (with participation of the Ministry for General and Professional Education of the Russian Federation) agreement or protocol.
          If equivalence of education or academic degree documents is established by a intergovernmental interdepartmental or agreement or report, the division shall issue a relevant certificate.
          5. The division may delegate solution of some issues connected with recognition and determining the equivalence of documents to educating-methodical associations in higher educational institutions, methodical services of administrative bodies in educational establishments of the general and professional education, to expert groups of experienced employees in the education system and to submit additional criteria of acceptance and equivalence to the management of the Ministry for approval.
          6. Recognition and determining the equivalence of international documents confirming education and academic degrees and issuing relevant certificates shall be performed against application of the document bearer or relevant organization.

Arranging procedure of accepting documents confirming education and academic degrees

          7. Following materials are attached to the application for accepting education or academic degree documents:

  • Properly legalized document confirming education or academic degree (the original or a notarized copy).

  • Properly legalized supplement to the document confirming education (the original or a notarized copy) covering the title of training courses and their volume, final achievements report, list of practical works, student essays and graduate qualifying works, and other components of educational process.

  • Notarized translation of the document confirming education or academic degree and of the supplement.

          The applicant has also the right to present other evidence proving his qualification including documents confirming subsequent educational levels, admittance to professional employment, or practical experience.
           If necessary, the division may also demand some back-up documentation from the applicant, from the relevant educational institution, and from Russian and foreign organizations.
          The materials and documents used in the acceptance process shall be supported by a notarized translation.
          The translation, as a rule, shall be notarized by a Russian notary or the embassy (consulate) of the Russian Federation in the country which has issued the document confirming education or academic degree. In some cases translation may be notarized by embassy (consulate) in Russia of the state on which territory the document confirming education or academic degree has been issued.
          8. Procedure of accepting international documents confirming education and academic degrees shall be performed based on available international agreements and recommendations, state educational standards and statutory acts of the educational system of Russia.
          9. In order to be accepted the document confirming education or academic degree shall meet following requirements:

  • The educational institution which has issued the document confirming education or academic degree should be recognised by relevant authorities of the country by which this document was issued.

  • The document confirming education or academic degree should be recognised in the country where it was issued.

  • Recognition of a document confirming education or academic degree should be supported by an international contract of the Russian Federation.

          10. The term of considering documents submitted by an applicant, as a rule, shall be three weeks or less as of the date of arrival of all required materials including supporting information.
          11. Unaccepted international documents confirming education and academic degrees shall be returned to the applicant after explaining the reasons for rejection.
          12. The certificate of recognition of the international document confirming education (Appendix 2) shall be handed either to the applicant personally or to his representative under his assignment or sent via registered mail.
          13. The certificate of recognition of the education document issued by a foreign state shall grant the right to be admitted to an educational institution realizing educational programs of the relevant level in territory of the Russian Federation giving credit to previously studied subjects. Thus, the international document confirming education is considered as an academic transcript. Admission conditions are defined by the current legislation.
          14. When admitting to professional employment, conformity of international documents on education and academic degrees to the Russian documents confirming education and academic degrees is defined by the above-stated division based on the establishment of equivalence.

           Arranging the procedure of determining the equivalence of the documents confirming education and academic degrees

          15. Following documents are attached to the application for the determining of equivalence:

  • Properly legalized document confirming education or academic degree (the original or a notarized copy).

  • Properly legalized supplement to the document confirming education (the original or a notarized copy) covering the title of training courses and their volume, final achievements report, list of practical works, student essays and graduate qualifying works, and other components of educational process.

  • Notarized translation of the document confirming education or academic degree and of the supplement.

          If necessary, the applicant may be required to provide additional documentation (detailed information about special courses, previous education and the like).
          If necessary, the division may also demand some back-up documentation from the applicant, from the relevant educational institution, and from Russian and foreign organizations.
          The applicant has also the right to present other evidence proving his qualification including documents confirming subsequent educational levels, admittance to professional employment, or practical experience.
          The materials and documents used in determining the equivalence shall be supported by a notarized translation.
          The translation, as a rule, shall be notarized by a Russian notary or the embassy (consulate) of the Russian Federation in the country, which has issued the document confirming education or academic degree. In some cases translation may be notarized by the embassy (consulate) in Russia of the state on which territory the document confirming education or academic degree has been issued.
          16. Procedure of determining the equivalence of international documents confirming education and academic degrees includes:

  • analysis,
  • decision-making,
  • registration and
  • issuing a certificate of equivalence.

          17. Analysis includes:
  • recognition of the documents confirming education and academic degrees;and
  • determining conformity of the international education content to the Russian state educational standards.

          18. Procedure of determining conformity of the international education content to the Russian state educational standards regarding state requirements to the content minimum and to the training level of educational institutions graduates is performed after the recognition of international education documents.
          The determining of conformity of the education content is performed by educational-methodical associations (in higher professional education), methodical services of educational establishments administrative bodies in high professional education organizations, and expert groups of experienced employees of the education system.
          Analysis should take into account:
          - Content and evolution of curricula and education programs;
          - Availability of admission tests;
          - System of examinations and tests;
          - Ratings (achievements) of students in the course of education;
          - Volume of studied subjects;
          - Availability and duration of practical courses;
          - Availability and level of the final qualifying certification;
          - Availability and theme of the graduating qualifying work;
          - Type of attendance;
          - Additional education available.

          Knowledge and experience are assessed with regard to the final training recognizing possible distinctions in curricula and methods of training.
           In some cases interviews and trial tests are allowed.
Reasonable expert judgement about conformity of the international education content to the Russian state educational standards or reasons of discrepancy and possible ways of its elimination is submitted to the division.
          19. The applicant has the right to familiarize with the expert opinion.
          20. Following of the expert judgement, based on the comparison of general requirements to the structure of education in the country issuing the education document and in Russia, taking into account international obligations accepted by the Russian Federation and conformity to the criteria of equivalence, the Ministry shall make a decision about the determining of equivalence and issue a relevant certificate (appendices 3-9).
          21. The decision about issuing a certificate on equivalence is made based on:
          - The positive conclusion about recognition the document of education
          - The positive expert judgement about conformity of the education content
          - Conformity of the general requirements to the structure of education in Russia and in the country issued the document confirming the education
          - International agreements on the equivalence and obligations signed and accepted by the Russian Federation.
          22. Adverse conclusion on one of these items may cause the refusal to issue a certificate of equivalence.
          Negative decision on the equivalence of international education documents may also be made, if:
          - Total standard training period (after finishing a full course of secondary education) for recieving a document confirming vocational training in the foreign state is at least 0,5 years shorter than it is stipulated by the Russian state educational standard.
          - In the country where education documents is issued the academic or/and professional rights of their bearers are more restricted than in Russia (for example, bearer of an education document has no right to be admotted to higher educational institutions, magistracy or doctorate, or have no right for professional employment).
          - Specialization is not included in the Russian catalog of areas and specialities in elementary, secondary and higher professional education (for example, chiropractics, cosmetology and etc.).
          - The education document certifies correspondence and fulltime-correspondence course on specialties and areas where such form of training is not allowed in the Russian Federation.
          If in the country where education documents are issued the academic or/and professional rights of their bearers are more restricted than in Russia (for example, bearer education document has no right of admittance to higher educational institutions, magistracy or doctorate, or have no right for professional employment), certificate of equivalence may include a record setting limits to academic or professional rights of the international education document bearer.
          23. The certificate of equivalence shall be signed by the Deputy Minister supervising activities of the Ministry in the field of recognition and determining the equivalence of documents, shall be sealed by the official Ministry stamp and shall be handed either to the applicant personally or to his representative under his assignment or sent via registered mail.
          24. The term of considering documents submitted by an applicant, as a rule, shall be one month or less as of the date of arrival of all required materials including supporting information.
          25. As advised by the division, the Ministry issues an order approving periodically reconsidered list of international education documents which are recognised as equivalent in the Russian Federation in the field of general education in order to admit applicants seeking to proceed with further education and may be accepted for the first year to educational establishments of elementary, secondary and higher professional education. In this case certificate of recognition or equivalence in is not mandatory.
