A sample of tenancy agreement with a university



Contract No. _______on dwelling in a hostel of .university of a foreign citizen studying in under a CONTRACT

         university, hereinafter referred to as the "UNIVERSITY", represented by the Pro-rector for teaching and educational work with foreign students and international contacts, Professor, acting under the Charter, on the one hand, and the student (intern, registrar, post-graduate student, doctoral degree student)

hereinafter referred to as the "STUDENT", on the other hand, have made this contract as follows:


1. SUBJECT OF THE CONTRACT

1.1. The UNIVERSITY shall provide the STUDENT with a bed in a three-bed room in the student hos-tel No. ____.

1.2. The STUDENT shall be accommodated in the hostel on basis of the contract and accommodation order which is an integral part of the contract.


2. RESPONSIBILITIES AND RIGHTS OF THE UNIVERSITY

2.1. In accordance with the applicable legislative, legal norms and orders of the rector, the UNIVERSITY shall establish for the STUDENT the amount of payment for hostel accommodation.

The UNIVERSITY shall:

2.2. Provide the STUDENT with necessary inventory furniture and bedding, shall fund the expenses for supply of gas, water and electricity, respective inventory and equipment for cultural, sports and recreation events and activities, and also disinfestation measures and disinfection of premises.

2.3. Provide the STUDENT with additional utility and domestic services which are not directly related to the study process, including personal energy-consuming electric appliances and devices (except for heating and fire dangerous, specified in the official list and prohibited to be used in hostels), and additional lighting.

2.4. Provide the furnished premises (reading rooms) in the hostel for the STUDENT to prepare for the classes.

2.5. Provide for the storage of the STUDENT'S bulky personal goods in the hostel check-room. The UNIVERSITY shall not be held liable for the security of the STUDENT'S documents and money.

2.6. As set forth by applicable laws, register the STUDENT in the student hostel.

2.7. To ensure the STUDENT'S secure dwelling in the hostel, arrange for the guarding of the hostel and ID card-based regime of entry to the hostel. The STUDENT will be issued an ID card of the established form.

2.8. Provide for cleaning of the hostel common areas, including lavatories, cooking rooms and corridors.

2.9. In due time carry out major overhaul of the hostel and timely repair of power- and water-supply networks, gas equipment and elevators.

2.10. As required, have the right to move the STUDENT into another room in the same hostel, provid-ing equivalent utility and domestic services.

2.11. Have the right to terminate this contract ahead of time in case of:
1) breach by the STUDENT of the hostel internal regulations, including one-time appearance in the hostel intoxicated or drugged, either alone or together with invited guests;
2). non-payment for hostel accommodation within 3 months;
3) non-dwelling in the hostel for reasons not known to the hostel administration within one month;
4) disenrollment of the STUDENT from the UNIVERSITY;
5) offenses resulting in bringing to administrative and criminal responsibility or sentencing to imprisonment;

2.12. In due time inform the STUDENT of his/her rights and responsibilities, and of the regulatory documents related to the organization of operation of student hostels and amendments thereto.

2.13. Subject to changes and indexation of prices for utility and other types of services, the UNIVERSITY reserves the right to change the amount of payment for hostel accommodation.

2.14. Provide for the work of the hostel tutor.

2.15. In hostels with more comfortable conditions, provide for the work of an around-the-clock room attendant.

2.16. As agreed with the students, in hostels with more comfortable conditions, for extra pay, may provide refrigerators, washing machines, exercisers, access to Internet and other additional services.


3. RESPONSIBILITIES AND RIGHTS OF THE STUDENT

The STUDENT shall:

3.1. Comply with the Student Hostel Internal Regulations, general safety and fire safety rules, sanitary standards of dwelling in a hostel, as well as observe personal hygiene.

3.2. Clean the hostel room he/she occupies, keep clean hostel common areas.

3.3. At the end of the academic year, return to the hostel warden all issued to him/her bedding, furniture, implements, equipment and key to his/her room.

3.4. As set forth by applicable laws, bear property responsibility for damage to inventory equipment or furniture, whether in his/her room or common areas, as well as for loss of household implements in the amount of actual damage to be determined by a report of the UNIVERSITY administrative and maintenance department.

3.5. In addition to the instances provided for in paragraph 3.4. above, bear personal property responsibility where the property damage was caused to the UNIVERSITY by the guests invited to the hostel by a STUDENT.

3.6. Upon completion of studies, and in case of disenrollment from the UNIVERSITY or academic leave, the STUDENT'S registration shall in accordance with the established procedure be cancelled and the STUDENT shall vacate the hostel room within 5 days, having returned to the warden the respective inventory equipment received during the period of living in the hostel.

3.7. Before moving in, the student shall pay in full for the entire period of living in the hostel during the year.

3.8. Participate in elections to the student government bodies, including to the student council.


4. DURATION OF THE CONTRACT

4.1. This contract shall take effect upon its signature by the parties and shall be valid until the completion by the STUDENT of the basic studies in the UNIVERSITY. The question of the possibil-ity of the Student's dwelling in the hostel is decided annually depending on the availability of rooms in the hostel. Preference is given to first-year students and students taught in English.

4.2. This contract shall become inoperative ahead of time upon its termination initiated by the UNIVERSITY in cases provided for in paragraphs 2.11 and 3.6 above.

4.3. The contract may be terminated ahead of time on the STUDENT'S initiative at any time.

4.4. Any other conditions that are not specifically covered by this contract shall be effective only if made in the form of additional agreement which is an integral part hereof.

4.5. Conditions provided for by legislation but not covered in this contract shall be effective irrespective of this contract.

4.6. The contract is made in 2 copies, one copy for each of the parties.


5. OTHER PROVISIONS

5.1. Upon the STUDENT'S moving up to another year of study, the STUDENT'S hostel accommodation may be extended by a respective note in the order under the signature of the Pro-rector, subject to the availability of vacant rooms in the hostel and absence of claims against the Student on the part of the hostel administration during his/her stay in the hostel (in accordance with paragraphs 2.11 and 3.1 through 3.6 above).
